Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the IcePlan mobile application (“IcePlan” or “the App”), operated by Eukosvit LLC (“Eukosvit,” “we,” “us,” or “our”), a Texas limited liability company. By creating an account or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Accounts and Eligibility

To use IcePlan you must create an account. The following account types are available:

• Team Organizer — self-registers and creates a team (club). Responsible for managing coaches, students, rinks, and schedules within that team.
• Coach — self-registers or registers via an invitation code issued by a Team Organizer.
• Student — registers using an invitation code issued by a Team Organizer or Coach. Student accounts cannot be created without a valid invitation code.
• Parent — self-registers and links to one or more student accounts to view and manage a child’s schedule.

You must be at least 13 years old to create an account. If you are under 13, a parent or guardian must complete registration on your behalf. By creating an account, you represent that you meet this age requirement.

Team Organizers and Coaches who issue invitation codes to minor athletes are responsible for ensuring that appropriate parental consent has been obtained before the minor completes registration, in accordance with the Children’s Online Privacy Protection Act (COPPA) and any other applicable law.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at [email protected] if you believe your account has been compromised.

2. Acceptable Use

You agree to use IcePlan only for its intended purpose: managing figure skating schedules, lessons, and team activities. You agree not to:

• Impersonate another person, coach, student, or team organizer, or misrepresent your identity or affiliation.
• Use scheduling or personal data accessed through the App for any purpose outside of legitimate team management (e.g., commercial solicitation, harassment, or unauthorized profiling).
• Attempt to access data belonging to another team or user account that you are not authorized to view.
• Interfere with or disrupt the App’s servers, networks, or security features.
• Use the App to transmit spam, abusive messages, or content that is unlawful, defamatory, or harmful.
• Reverse-engineer, decompile, or attempt to extract the App’s source code.

We reserve the right to suspend or terminate any account that violates these restrictions without prior notice.

3. Scheduling Data and Team Records

Scheduling records created within IcePlan — including lesson schedules, attendance records, student rosters, coach assignments, and team events — belong to the team (club) that generated them. Eukosvit acts as a data processor on behalf of the team; we do not claim ownership of your team’s scheduling data and do not use it for any purpose beyond operating the App.

If a Team Organizer account is deleted or a team is dissolved, scheduling records may be anonymized or deleted in accordance with our Privacy Policy. We recommend that teams export or retain copies of any records they may need before closing an account.

4. Account Termination

You may delete your account at any time from within the App under Settings › Delete Account. Deletion permanently deactivates your account and removes your personal information in accordance with our Privacy Policy.

We may suspend or terminate your account at any time if we determine that you have violated these Terms, engaged in fraudulent or abusive behavior, or if required by law. We will attempt to provide notice where practicable, but are not obligated to do so in cases of serious violations.

5. Intellectual Property

IcePlan and all related software, design, trademarks, and content are the property of Eukosvit LLC and are protected by applicable intellectual property laws. These Terms do not grant you any rights to Eukosvit’s intellectual property beyond a limited, non-exclusive, non-transferable license to use the App for its intended purpose while your account is active.

6. Disclaimer of Warranties

IcePlan is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.

We reserve the right to modify, suspend, or discontinue the App or any feature at any time without notice.

7. Limitation of Liability

To the fullest extent permitted by law, Eukosvit LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App, including but not limited to loss of data, scheduling errors, or missed communications, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising out of or related to the App shall not exceed the amount you paid to us, if any, in the twelve months preceding the claim.

8. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions. Any dispute arising out of or related to these Terms or your use of the App shall be subject to the exclusive jurisdiction of the state and federal courts located in Texas.

Before initiating any formal proceeding, you agree to contact us at [email protected] to attempt to resolve the dispute informally. We will make a good-faith effort to reach a resolution within 30 days.

9. Changes to These Terms

We may update these Terms at any time. If we make material changes, we will update the date above and, where required by law, notify you through the App or by email. Continued use of the App after changes take effect constitutes your acceptance of the revised Terms.
